Visitor Conditions
Article 1: General Provisions: Definitions
Article 1.1
The term 'the museum' refers to Museum Schokland, including, but not limited to, all paid and unpaid (museum) officials authorized to act on behalf of this organization.
Article 1.2
The term 'the museum complex' refers to the entirety of spaces and grounds (built and unbuilt) that fall under the legal or administrative authority of the museum, including, but not limited to, exhibition halls, meeting rooms, outdoor areas, parking lots, and all other spaces in the building complex, depots, and branches.
Article 1.3
The term 'visitor' refers to anyone who contracts in any way, directly or indirectly, with the museum or any other organization that grants access to the museum complex to enter and/or visit an exhibition or attend an activity.
Article 1.4
These general Visitor Conditions apply to anyone who enters the museum complex.
Article 2: Ticket Sales, Offers, and Prices
Article 2.1
All price quotations, announcements, or other information provided by the museum are not without obligation. The museum accepts liability for any errors made by the museum itself in price quotations, announcements, or other information provided to the visitor. This liability only applies to the museum's own informational material available at the time of the claim or distributed recently by or explicitly on behalf of the museum. The museum is not liable for mistakes caused by intent, negligence, or default by third parties. Discounts cannot be stacked. Discount schemes and actions do not apply to reduced rates for children, CJP cards, etc., unless this is explicitly indicated for these categories.
Article 2.2
The visitor is at all times required to show the access ticket and any card or voucher that gives entitlement to a discount on the admission price to authorized museum officials, including cashiers, upon request.
Article 2.3
The potential visitor is not entitled to a refund of the admission price or any other compensation in the event of loss or theft of the access ticket before entering the museum complex.
If a potential visitor does not make use of the previously purchased access ticket, this is at the visitor's own expense and risk; this applies even if the access ticket is only valid for a specific time and/or date. A once obtained access ticket cannot be exchanged. There will also be no refund of the admission price. The paid admission price can, however, be refunded if circumstances beyond the control of the buyer make the museum visit impossible, but this is at the museum's discretion.
Article 2.4
Access to the museum complex can be denied to a potential visitor when it appears that the access ticket, discount card, or voucher was not obtained from the museum or an entity authorized by the museum.
Article 2.5
The museum refunds the actual admission price paid by the visitor only if the visitor must leave the museum complex early due to an unannounced exercise as part of emergency response (Article 23 of the Occupational Health and Safety Act), but not in the case of an actual calamity that results in the museum complex being evacuated in whole or in part (force majeure).
Article 3: Stay in the Museum Complex
Article 3.1
During their stay in the museum complex, the visitor must behave in accordance with public order, good morals, and the applicable rules of decorum concerning the activity being visited. The visitor is also obliged to promptly follow all instructions and directives given by authorized museum officials.
If, in the reasonable opinion of an authorized official of the museum, the visitor acts in violation of these norms, instructions, or directives in any way, the visitor may be denied further access to the museum complex, without the visitor having any right to compensation for the cost of the access ticket or any other incurred costs.
Article 3.2
Parents or guardians of children are always responsible for and accountable for the behavior of the children they bring with them. Teachers and leaders of groups are responsible for and accountable for the behavior of the group members they supervise.
Article 3.3
The visitor is prohibited from, among other things, in the museum complex:
- offering goods of any kind for sale to third parties, or providing them free of charge. Exceptions may be made for activities and events organized by the museum;
- intentionally and for an extended time blocking the way of other visitors or obstructing the view of displayed objects;
- disturbing other visitors, including, but not limited to, through the use of mobile phones, walkmans, or other sources of noise pollution; the use of such equipment may however be explicitly allowed in certain areas by the museum;
- bringing (house) pets, unless they are explicitly allowed in certain areas or when it concerns guide dogs for the blind that accompany a visitor with identification;
- smoking in all enclosed spaces.
- bringing and/or consuming self-brought food and drinks in the enclosed spaces of the museum complex;
- bringing dangerous objects or substances into the museum complex, including, but not limited to, walking sticks, umbrellas, or large bags; these may be surrendered at a location designated by the museum;
- touching displayed objects and exhibition materials such as showcases, lighting, partitions, and the like, unless this is explicitly permitted. Parents or guardians of children must strictly supervise that displayed objects are not touched by the children they bring. Small children must be held by the hand or transported in a stroller; similarly, teachers and group leaders must ensure that the group members they supervise do not touch the displayed objects.
Article 3.4
In exceptional cases where the general safety of persons or the collection reasonably requires it, an official of the museum may, including but not limited to, request to inspect the (hand) luggage carried by the visitor. If deemed necessary, specially trained personnel may additionally request the visitor to cooperate in a security check when entering or leaving the museum complex.
Article 3.5
Unless with prior written or oral permission from an authorized museum official, the visitor is prohibited from taking photographs, video, and film recordings using lighting, flash equipment, and tripods.
Furthermore, it is prohibited, except with prior written permission from an authorized museum official, to publish or reproduce these photographs, videos, and film recordings in any way and by any medium, including electronic media.
Article 3.6
The museum can permanently or temporarily deny access to the museum complex to any visitor who has intentionally damaged an item during one or more previous visits to a Dutch museum complex, or whose behavior raises concerns about damage or other behavior deviating from reasonable norms, or behaves inappropriately, indecently or noisily (including but not limited to unusual clothing, negative expressions towards the museum and/or related persons and/or what is shown in the museum) at the sole discretion of the museum; in any event, the museum may subject this visitor to measures as mentioned in Article 3.4 of these Visitor Conditions during all their visits.
The decision to deny access must be communicated to this visitor without delay and with justification.
Article 3.7
The visitor accepts that by agreeing to access, the museum records the visitor's behavior through security cameras and webcams upon their entry into the museum and captures them on video and via the internet, and in relevant cases disseminates this. This can never lead to a complaint or claim from the visitor. The same applies in the event that the visitor is captured by the museum and/or others in the museum complex (including outdoor areas) in photographic or video material that is later published.
Article 4: Complaints and Claims
Article 4.1
The museum will do everything possible to ensure that the visit to the museum complex or the exhibitions and activities organized by the museum proceeds according to the published offerings; this includes the obligation to inform the public as well as possible about the total, partial, or premature closing of the museum complex and/or exhibitions organized by the museum. This can be done via the museum's website, where closures are announced. Furthermore, the museum informs the potential public about maintenance work causing inconvenience, renovations, or the (re)arrangement of spaces. The visitor can never derive a right to compensation from closure or limited access or inconvenience caused by works.
Article 4.2
Claims are not possible regarding the following complaints and circumstances that the museum cannot avoid and therefore never lead to any obligation to compensate by the museum to the visitor:
- complaints regarding the invisibility of objects from the museum's permanent collection;
- complaints regarding the partial closure of the museum complex, including but not limited to, partial closure due to setting up or dismantling exhibitions;
- complaints and circumstances related to disturbances or inconveniences caused by other visitors, including but not limited to, noise disturbances, inappropriate behavior, theft, and vandalism;
- complaints and circumstances related to disturbances or inconveniences caused by maintenance work, including but not limited to, renovations or the (re)arrangement of spaces;
- complaints and circumstances related to disturbances or inconveniences caused by the malfunctioning of facilities in the museum complex and/or the complete or partial closing of the museum.
Article 4.3
Complaints about and requests for refunds regarding the agreement between the museum and the visitor must reach the head of the museum in writing within six weeks after the visit took place. Complaints and requests for claims submitted after this period will not be processed.
Article 4.4
The museum will investigate the complaint and respond in writing within 30 days if possible.
Article 4.5
The visitor can send suggestions for improvement by post or email to the head of the museum.
Article 5: Liability of the Museum
Article 5.1
The museum is never liable for damage caused as a result of price quotations, announcements, or other forms of information provided to the visitor by employees of the museum and/or the museum's website and/or third parties, unless and insofar as this damage is the direct result of intent or gross negligence on the part of the museum.
Article 5.2
The visitor's stay in the museum complex is at their own expense and risk. The museum is only liable for property and/or consequential damage suffered by the visitor or injury inflicted on the visitor that is the direct and sole result of intent or gross negligence of the museum, with the understanding that only that damage is eligible for compensation which the museum is insured against, or which it would reasonably and equitably have been obligated to insure against.
Article 5.3
In no event is the museum obliged to pay a higher amount in damages than:
- the actual admission price paid or, if that is higher;
- the amount paid by the insurer to the museum for the damage concerned, or;
- the compensation obtained from another third party for the damage.
Article 5.4
The museum is never liable for any damage caused to the visitor's vehicles unless and to the extent that the damage occurred on or in the museum complex and this damage is the direct result of intent or gross negligence on the part of the museum.
Article 5.5
The museum is never liable for any (indirect) damage arising as a result of any defect, quality, or circumstance in, on, or related to any immovable property of which the museum is the holder, (lease)holder, tenant or owner or that is otherwise at the museum's disposal, unless and to the extent that the damage is the direct result of intent or gross negligence of the museum.
Article 5.6
If the museum receives goods or if goods are deposited, stored, and/or left in any way by anyone in any place without the museum requiring any compensation for that, then the museum is never liable for damage to or in connection with goods arising in any way unless the museum has intentionally caused the damage, or the damage is a result of gross negligence of the museum.
Article 5.7
The total liability of the museum for attributable shortcomings in the performance of the visitor agreement is limited to the compensation of direct damage and shall never exceed the damage compensation arrangement described in 5.3.
Article 5.8
In the event of damage due to death or bodily injury, the total liability of the museum shall in no case exceed the damage compensation arrangement described in 5.3.
Article 5.9
The museum's liability for indirect damage, including consequential damage, lost profits or wages, missed savings, etc., is excluded.
Article 5.10
The maximum amounts mentioned in article 5.3 cease to apply if and to the extent that the damage is a result of gross negligence of the museum.
Article 6: Force Majeure
Article 6.1
Force majeure for the museum means any unforeseen circumstance that makes the execution of the agreement by the museum so difficult that, temporarily or permanently, the execution of the agreement becomes impossible or burdensome.
Article 6.2
Such circumstances also include circumstances involving persons and/or services and/or institutions that the museum uses in executing the visitor agreement, as well as everything that applies as force majeure or suspensive or dissolving conditions for the aforementioned.
Article 7: Lost Property
Article 7.1
Items found by the visitor in the museum complex can be handed in at the museum's ticket desk.
Article 7.2
The museum will make efforts to trace the owner or rightful claimant of the found item.
Article 7.3
If the owner or rightful claimant of a found item comes forward, they have the choice to pick up the goods themselves or to have them sent cash on delivery. In both cases, the owner or claimant must prove their identity properly.
Article 8: Other Conditions
Article 8.1
The applicability of these Visitor Conditions does not affect the possible applicability of other (contractual) conditions and/or regulations of the museum, or third parties from whom the visitor obtained their access ticket.
Article 9: Applicable Law
Article 9.1
These Visitor Conditions and the agreement between the visitor and the museum are governed by Dutch law.
Article 9.2
All disputes arising from the agreement between the visitor and the museum shall be exclusively submitted to a competent court for adjudication.
